"On Thursday, only a day after Marco Rubio took to the Senate floor to mock the idea that “our government last year was almost overthrown by a guy wearing a Viking hat and speedos,” the department released an indictment charging the founder and leader of the Oath Keepers militia and 10 other people with seditious conspiracy. The indictment alleged an armed “plot to oppose by force the 2020 lawful transfer of presidential power” and “take control of the Capitol” on Jan. 6 to prevent the certification of the Electoral College vote in favor of Joe Biden." Seditious conspiracy is a crime in various jurisdictions of conspiring against the authority or legitimacy of the state. As a form of sedition, it has been described as a serious but lesser counterpart to treason, targeting activities that do not actually attack the state but are hostile to its authority.

A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.

So these people have been charged with sedition. Trump's actions on Jan 6 and before that would fall under the "failure to suppress or report a mutiny or sedition"

If they don't charge them with treason, or insurrection, sedition is applicable to these people's actions.
