When Clarence Thomas was nominated was that because of affirmative action? It's been around since 1965. Title 9 education amendment's been around since 1972. Sometimes you have to make a law because otherwise nothing ever gets done, and what the heck is wrong with nominating a black woman with a background in Constitutional Law, or even U.S. Law?
